PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING ANY MICHIGAN MORTGAGE SOLUTIONS SERVICE. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

These Terms of Use ("Terms") govern your access to and use of all Michigan Mortgage Solutions digital properties, including:

• www.homenowmichigan.com

• www.mmswebinars.com

• The MMS DocAssist mobile application ("the App"), available on iOS and Android

All of the above are referred to collectively herein as "our Services." These Terms constitute a legally binding agreement between you and Michigan Mortgage Solutions ("we," "us," or "our"), operated by Trevor Sines, NMLS #136972, located at 35 W Huron St, Suite #301, Pontiac, MI 48342.

These Terms are subject to change at any time at our discretion. We will update the "Last Revised" date at the top of this page when changes are made. Your continued use of our Services after any update constitutes your acceptance of the revised Terms.

1. ELIGIBILITY

You must be at least eighteen (18) years of age to use our Services. By using our Services, you represent and warrant that you are 18 years of age or older and that you have the legal capacity to enter into a binding agreement. Our Services are intended for use by residents of the United States only.

If you are accessing or using our Services on behalf of a business entity, you represent that you have authority to bind that entity to these Terms, and references to "you" include both you individually and the entity you represent.

2. NOT A COMMITMENT TO LEND

Nothing on our Services, including mortgage calculators, rate estimates, pre-qualification results, loan scenarios, or any other tool or content, constitutes a commitment, offer, or guarantee of a mortgage loan or any specific rate, term, or product.

All rates, calculations, and figures displayed through our Services are estimates for informational and planning purposes only. Actual loan terms, interest rates, fees, and eligibility are subject to credit approval, underwriting, property appraisal, and market conditions at the time of application. Your actual rate and fees may differ significantly from any estimate provided.

Michigan Mortgage Solutions is a licensed mortgage broker. Loans are subject to lender approval.

3. USE OF OUR SERVICES

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree that you will not:

• Use our Services in any way that violates applicable federal, state, or local law or regulation

• Use our Services to submit false, misleading, or fraudulent information in connection with a mortgage application or inquiry

• Attempt to gain unauthorized access to any part of our Services, our servers, or any systems connected to our Services

• Use any automated tool, scraper, bot, or similar technology to access, collect, or extract data from our Services without our prior written consent

• Interfere with or disrupt the integrity or performance of our Services

• Transmit any harmful, offensive, or disruptive content through our Services

• Impersonate any person or entity, or misrepresent your affiliation with any person or entity

• Use our Services to transmit unsolicited commercial communications

We reserve the right to suspend or terminate your access to our Services at any time, for any reason, without notice.

4. THE MMS DOCASSIST MOBILE APPLICATION

The MMS DocAssist App is a mortgage loan assistance tool that allows you to submit personal and financial information, upload documents, use mortgage calculators, and communicate with a Michigan Mortgage Solutions loan officer in connection with a mortgage loan application or inquiry.

By using the App, you acknowledge and agree that:

(a) Information you submit through the App will be used to process your mortgage inquiry or application and may be shared with lenders, underwriters, and service providers as necessary to facilitate your loan.

(b) The App requires you to provide accurate, complete, and truthful information. Providing false or misleading information in connection with a mortgage application is a federal crime under 18 U.S.C. § 1014.

(c) Submitting information through the App does not guarantee loan approval, a specific rate, or any particular loan product.

(d) Document uploads are transmitted and stored using industry-standard encryption. You are responsible for ensuring that any documents you upload belong to you or that you have authorization to submit them.

(e) Calculator results within the App are estimates only and are not a commitment to lend. See Section 2 above.

(f) You are responsible for maintaining the confidentiality of any login credentials associated with your App account and for all activity that occurs under your account.

5. SMS / TEXT MESSAGE TERMS

By providing your mobile phone number and opting in to receive SMS communications from Michigan Mortgage Solutions, you agree to receive recurring automated and non-automated SMS/MMS text messages, including loan status updates, document requests, appointment reminders, rate information, and follow-up communications.

Message frequency varies. Message and data rates may apply.

You may opt out at any time by replying STOP to any text message we send. For help, reply HELP or contact us at (248) 963-1894 or [email protected].

Consent to receive SMS messages is not a condition of purchasing any product or service. Our SMS program operates in compliance with the A2P 10DLC framework as required by U.S. wireless carriers. For full details, see our Privacy Policy.

6. CALCULATOR AND RATE TOOLS — DISCLAIMER

Our Services include mortgage calculators and rate estimation tools for Home Purchase, Refinance, Fix & Flip, Ground Up Construction, DSCR, and Bridge loan scenarios.

These tools are provided for informational and planning purposes only.

All calculations and rates are estimates based on inputs you provide and market data available at the time of use. They do not account for all factors that affect actual loan pricing, including but not limited to:

• Your individual credit profile and credit score

• Property type, condition, and location

• Loan-to-value ratio and down payment

• Borrower experience (for investor loan products)

• Lender overlays and underwriting guidelines

• Current market and rate conditions

Investor loan rates displayed in our calculator tools are calculated at a reference rate for illustration purposes. Your actual rate may be higher or lower. The display of any rate does not constitute a rate lock or rate commitment.

7. INTELLECTUAL PROPERTY

All content on our Services, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Michigan Mortgage Solutions or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may access and use our Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from our Services without our prior written consent, except as follows:

• You may print or download a single copy of materials for your personal, non-commercial reference use

• You may share links to our pages, provided you do not misrepresent our content or your affiliation with us

Any unauthorized use of our content may violate copyright, trademark, and other applicable laws.

8. THIRD-PARTY LINKS AND CONTENT

Our Services may contain links to third-party websites, products, or services. These links are provided for your convenience only. We do not endorse, control, or assume any responsibility for the content, privacy practices, or terms of any third-party site or service. You access third-party links at your own risk and subject to the terms and conditions of those third-party sites.

9. PRIVACY

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy. 10. DISCLAIMER OF WARRANTIES

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MICHIGAN MORTGAGE SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• Our Services will be uninterrupted, timely, secure, or error-free

• The results obtained from using our Services will be accurate or reliable

• Any errors in our Services will be corrected

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MICHIGAN MORTGAGE SOLUTIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Michigan Mortgage Solutions, its officers, directors, employees, agents, licensors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

(a) Your use of or access to our Services;

(b) Your violation of these Terms;

(d) Any information or content you submit through our Services, including any false, misleading, or fraudulent information submitted in connection with a mortgage application.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of our Services shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, you agree that the dispute shall be resolved by binding arbitration administered in Oakland County, Michigan, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Oakland County, Michigan.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14. REGULATORY COMPLIANCE

Michigan Mortgage Solutions operates as a licensed mortgage broker in the State of Michigan and is subject to applicable federal and state mortgage lending laws and regulations, including but not limited to:

• The Real Estate Settlement Procedures Act (RESPA)

• The Truth in Lending Act (TILA) and Regulation Z

• The Equal Credit Opportunity Act (ECOA) and Regulation B

• The Fair Housing Act

• The Gramm-Leach-Bliley Act (GLBA)

• The Bank Secrecy Act / Anti-Money Laundering requirements

• Michigan mortgage broker licensing requirements

Nothing in these Terms limits or waives any rights you may have under applicable federal or state consumer protection or mortgage lending laws.

15. FAIR LENDING NOTICE

Michigan Mortgage Solutions is committed to equal opportunity lending. We make lending decisions without regard to race, color, religion, national origin, sex, marital status, age, familial status, disability, or any other characteristic protected by applicable law. If you believe you have been subject to discriminatory lending practices, you may contact the Consumer Financial Protection Bureau (CFPB) at www.consumerfinance.gov or (855) 411-2372.

16. APPLE APP STORE AND GOOGLE PLAY — ADDITIONAL TERMS

If you download the MMS DocAssist App through the Apple App Store, the following additional terms apply:

(a) These Terms are between you and Michigan Mortgage Solutions only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.

(b) Apple has no obligation to provide maintenance or support services for the App.

(c) In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price for the App, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

(d) Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, consumer protection claims, or intellectual property claims.

(e) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

If you download the App through the Google Play Store, Google Play's Terms of Service apply in addition to these Terms.

17. TERMINATION

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, with or without notice, effective immediately. If your access is terminated, all provisions of these Terms which by their nature should survive termination — including ownership provisions, warranty disclaimers, indemnification, and limitations of liability — shall survive.

You may stop using our Services at any time. If you have an account with the App, you may request account deletion by contacting us at [email protected].

18. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other legal notices published by us on our Services, constitute the entire agreement between you and Michigan Mortgage Solutions with respect to your use of our Services and supersede any prior agreements, communications, or understandings between you and us on this subject.
